Wi-Fi Terms of Use

By login to and/or using the WiFi service managed and operated by CTM (the “Service”), you are agreeing to be bound by these Terms and Conditions (the “Terms”) as well as by any applicable terms and conditions governing individual products and services provided by CTM, including General Terms & Conditions of Internet Services, Terms  and Conditions of the Provision of Mobile Services, and Acceptable Use Policy ("AUP").

 

In case of any inconsistency arising therefrom, these Terms shall prevail.

 

If you do not agree with these Terms, please do not use the Service.

 

1.CTM WiFi service

Customer can connect to the WiFi by any mobile devices supporting the Service within the coverage of wireless hotspots provided by CTM, either by (i) username and password; or (ii) the social media account specified by CTM.

 

2. Modification of the Terms

CTM may modify the Terms at any time at its sole discretion, and such modifications shall be effective immediately upon posting of the modified Terms at CTM’s website

You agree to review the Terms periodically to be aware of such modifications and your continued access to or use of this Service shall be deemed as your conclusive acceptance of the modified Terms.

 

3. Modification of the Service

CTM reserves the right to, at any time, without prior notice and in its sole and absolute discretion, to change, update, and improve the Service. You understand, acknowledge and expressly agree that CTM will not be liable to you or any third party for any modification of the Service.

 

4. Customer responsibility

You shall be permitted to use the Service only for personal and non-commercial use. In no circumstances can you use the Service for any commercial , criminal, illegal, unlawful or fraudulent purpose unless otherwise authorised by CTM.

 

You shall use the Service and ensure that third parties use its Wi-Fi network strictly in accordance with the Terms, any applicable service terms and conditions, applicable Law and any reasonable operating instructions issued by CTM from time to time.

 

You shall indemnify CTM against all actions, proceedings, damages, costs, claims or losses which may be sustained by CTM in connection with any use or misuse of the Service by you.

 

5. Disclaimer of Warranties

You understand and agree that you are solely responsible for your use of the Service.

 

CTM will use its reasonable endeavors to maintain the Service in good operating condition and take certain industry-accepted precautions from time to time to secure the Service or portions thereof, and CTM websites, so that they may be labeled as "secure" in accordance with industry practice in connection with the use of such precautions.  However, you expressly understand and agree that it is beyond CTM’s control to ensure the accuracy, reliability, completeness, timeliness, security, availability and performance of the Service and other internet-based resources and services or of any content transmitted or accessible via the internet and that CTM makes no warranty, guarantee, or representation that the use of the Service and any of CTM websites are uninterrupted or error-free and protected from all viruses, worms, Trojan horses, security threats or other vulnerabilities.

 

You understand and agree that the actual speed of the Service will be affected by the used device, technology, network and software, network configuration and coverage, usage levels and several extraneous factors, such as transmission technology or website servers speed.

 

Therefore, CTM makes no guarantee that (a) the Service will meet your requirements or will always be accessible, (b) the Service will be uninterrupted, timely, secure, error-free or free from computer virus or other invasive or harmful mechanisms, (c) the results or information that may be obtained from the use of the Service will be accurate or reliable, (d) the quality of any products, services, information, or other material obtained by you through the Service will meet your expectations, and (e) any errors in the Service or in the Software provided to you as part of the Service (if any) will be corrected.

 

6. Privacy

CTM is committed to safeguarding your personal information.  Personal information refers to all and any information relating to you, including, but not limited to your contact number and e-mail address, obtained by CTM via your use of the Service.

 

Whenever you provide us with information, CTM is legally obliged to use your information in line with all laws and regulations concerning the protection of personal information, including the Personal Data Protection Law (Law no. 8/2005). 

 

In order for you to understand the way CTM processes personal data, we suggest you to read and understand CTM’s Personal Data Collection and Processing Statement.

 

You understand and agree that the personal information you choose to provide may be held and used by CTM for a number of purposes connected with CTM’s business operations, and keep you informed about the new or updated features of CTM’s products and services.

 

CTM will not use your information for purposes other than those described above unless we have your consent.

 

CTM will only keep your information for as long as we are either required or allowed by law, or as is relevant for the purposes for which it was collected.

 

CTM may share your personal information with the government or regulatory agencies and law enforcement authorities in accordance with the law.

 

You understand and agree that any information you publish or share to the public through the Service (i.e. forums, chat rooms, bulletin boards, or other features that allow users to post information accessible by the public or the user population generally), becomes public information and will not be subject to the protection generally afforded your personal information.  You should exercise caution when disclosing your personal information in this way.  CTM shall have no responsibility for that activity.

 

7. Termination 

CTM may at any time, under certain circumstances and without prior notice terminate or suspend all or a portion of the Service, your account and your use of the Service.  Causes for termination shall include, without limitation, violations of these Terms, the General Terms and Conditions of Internet Services, Terms  and Conditions of the Provision of Mobile Services, or the AUP; request from you to cancel or terminate your access or use of the Service; request or order from competent authorities; where the provision of the Service to you becomes unlawful; technical or security issues or problems; your participation in fraudulent activities; your failure to pay fees or charges in respect of the Service (if any).  

 

8. Limitation of Liability

To the maximum extent permitted by law, in no event shall CTM be liable for any direct or indirect, special, incidental, consequential or any other losses or damages whatsoever (including but not limited to loss or corruption of data, loss of profits, goodwill, bargain or opportunity, or loss of anticipated savings, or business interruption, whether in contract or tort) arising out of or in connection with the use or access or the inability to use or access the Service, delays, inaccuracies or errors in the information or in the transmission of the Service or Content, or any information or Content provided on or over the Service or downloaded or shared via the Service, or performance of the Service, even if CTM has been advised of the possibility of such damages.

 

9. Severability

If any provision of these Terms, or the application thereof to any person or circumstances, is found to be invalid or for any reason, unenforceable by any court having competent jurisdiction, the invalidity or unenforceability of such provision shall not affect the validity and application of the remaining provisions of these Terms, which shall remain in full force and effect.

 

10. No Waiver

CTM’s failure to insist upon or enforce strict performance of any provision of these Terms shall not be construed as a waiver of any provision or right.

 

11. Governing Law and Jurisdiction 

Your use of the Service, as well these Terms, shall be governed by and construed in accordance with the laws of the Macau Special Administrative Region of the People’s Republic of China (the “MSAR”). The courts of the MSAR will have jurisdiction over any claims arising from or related to your use of the Service or from these Terms, although CTM hereby reserves the right to bring proceedings against you for breach of these Terms in your country of residence.
